Esther's attacker jailed for assault
A man has been jailed for three years for assaulting a woman who later died from her injuries.
Dubai Court of First Instance had heard how the jobless Emirati had punched and kicked 26-year-old Kenyan Esther Wanjiru Mwikamba in a car park off Sheikh Zayed Road.
Esther had intervened when the 23-year-old man started touching one of her friends.

A man has been jailed for three years for assaulting a woman in a Dubai car park who later died from her injuries
The court today convicted the Emirati of assault leading to death and handed down the three year sentence. The defendant was given another year behind bars for sexually molesting Esther’s friend.
Official records stated that in February Esther had been with two pals in the car park at around 3.30am when he began harassing Esther’s friend.
The friend said: “He touched me and I yelled at him. He claimed that because me and him had dark skin that touching between dark skin is normal. His friend apologized and claimed that the defendant was totally drunk.”
Esther’s other friend told the court that he pushed her friend away and he tried to punch her but Esther interfered.
The second friend said: 'The defendant became angry and punched her to the ground. He stood near her head and kicked her. He showed no mercy.
“He kicked her head four times. She was bleeding from her nose, ear and mouth. She was breathing very quickly but not responding.
“I started yelling for help. Some security men came. Esther was not moving. He then fled the scene in his black FJ Cruiser.”
After nearly a month in hospital in a coma Esther died on March 20.
Dubai Public Prosecution had asked for the toughest punishment possible and said it will appeal against the sentencing.
According to UAE law the maximum penalty for assault leading to death is 10 years in jail.

“This is just unbelievable. Taking someones life is such a big deal, and for him to spend 3yrs in prison is like letting him get away with it. He will probably get out and do it again to someone else. with all fairness he should spend the rest of his life in prison. At least he is lucky he gets to live, the poor girl died just because he choose to be selfish and disrespectful. I hope justice will be served.”

“3 years? This is murder no matter what the circumstances...he kicked the life out of her and should receive nothing less than his life in return. It boggles the mind that someone can do this and receive only 3 years as punishment yet other offences, that don't include the taking of someone's life!, receive much, much longer.”
